Terms and Conditions

1.Who we are
Memory Chest is a brand of Legacy Forge Holdings (Pty) Ltd, registration number 2026/783196/07, a company registered in South Africa (“we”, “us”). Contact: hello@memorychest.co.za.
2.These terms
These terms apply when you use this website, send us a photo, or order a Memory Chest. By placing an order you agree to them. Anything we confirm to you in writing about your specific order also forms part of your agreement.
3.Your order and deposit
You reserve a chest by paying the R5 000 deposit shown on the website. We will confirm the price, the number of photos and what is included before we start work. Your deposit is fully refundable on request until we engrave and send your chest. Because the chest is personalised with your family’s name, once it has been engraved and sent, the deposit covers the chest and courier and is no longer refundable. The balance is due only after you have seen and approved your First Look. If you don’t approve your First Look, we return your originals, you owe no balance, and you keep your chest. If we can’t take on your order, we refund everything you have paid.
4.Your photographs
You confirm that you own the photographs you send us, or have the permission of the family to send them. You keep all rights in your photographs and in the restored copies. We use them only to do the work you ordered. We will never use them in our marketing without your written permission.
5.Collection, care and return
We collect and return your chest by insured courier. We handle every original with care and return all of them to you. Old photographs can be fragile, so we can’t be responsible for damage caused by their existing condition, or for loss or delay caused by events outside our reasonable control.
6.Restoration
Restoration is done to the best of our ability. Some photographs are too damaged or blurry to restore fully, and results can vary. We restore what is there.
7.Free one-photo restore
The free offer is one photo per family. We may decline any photo without giving a reason. We delete the photo and its restored copy from our systems 30 days after we send it back, unless you order a chest.
8.Cancellations and refunds
You can cancel within 7 days of paying, as allowed by the Electronic Communications and Transactions Act, and we will refund your payment less any direct costs already incurred (for example, courier costs). The 7-day cancellation right does not apply once your chest has been engraved, because it is personalised for you. After work has started, we will refund any payment for work not yet done. Nothing in these terms limits your rights under the Consumer Protection Act.
9.Privacy
We collect only the details we need to deal with your enquiry or order, and we handle them in line with the Protection of Personal Information Act (POPIA). We never sell or share your details. You can ask us to see, correct or delete your information at any time by emailing hello@memorychest.co.za.
10.Liability
As far as the law allows, our total liability for any order is limited to the amount you paid us for that order.
11.Changes to these terms
We may update these terms from time to time. The version on this page when you place your order applies to it.
12.Law
These terms are governed by the laws of the Republic of South Africa.
